Former Congolese President Joseph Kabila has initiated legal proceedings in a United States federal court, aiming to contest sanctions Washington imposed on him in April 2026. The US government accuses Kabila of providing backing to the M23 rebel group and the Alliance Fleuve Congo (AFC) coalition, allegations the former head of state vehemently denies.
Legal challenge to US sanctions
Joseph Kabila filed his lawsuit in early August, seeking to overturn his designation on the blacklist maintained by the Office of Foreign Assets Control (OFAC), a division of the US Treasury Department responsible for enforcing economic sanctions. In a detailed sixteen-page complaint, his legal team disputes Washington’s decision, asserting that the accusations against him lack sufficient evidence and substantiation.
Kabila refutes allegations
American authorities allege that the former president offered financial and logistical assistance to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 group serves as its primary component. Washington also claims he encouraged Congolese military personnel to desert and resided in Goma, located in the eastern Democratic Republic of Congo (DRC), under the protection of the M23. Joseph Kabila staunchly rejects these accusations. His defense counsel argues that the evidence presented by the US administration is “vague” and “arbitrary,” failing to establish the specific facts of the alleged wrongdoing.
Defense demands concrete evidence
Attorneys representing the former president emphasize the absence of any identified precise financial transfers to the AFC within the US dossier. They further state that no specific Congolese military personnel are named as having been incited to desert by Joseph Kabila. His defense also highlights that in 2013, during his presidency, the Congolese army played a crucial role in defeating the M23.

Joseph Kabila, who governed the DRC from 2001 to 2019, is now petitioning the federal court in Washington to lift the sanctions and remove his name from the OFAC list.
